Terms of Service

These terms are an agreement between you and Wartle.Soft governing your use of BizTek. Please read them carefully. By using the App, you agree to them.

1. Acceptance of these terms

BizTek (the "App", "Service") is operated by Wartle.Soft ("we", "us", "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract to use BizTek. If you use the App on behalf of a business, you represent that you are authorized to bind that business to these Terms.

3. Your account

You need an account to use most features. You agree to provide accurate information, keep your credentials secure, and accept responsibility for all activity under your account. Notify us promptly at support@wartle.app of any unauthorized use. You are responsible for the actions of users you invite to your business.

4. License to use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, solely for your internal business purposes. We reserve all rights not expressly granted.

5. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable law or regulation.
  • Upload content that is illegal, infringing, fraudulent, or that you have no right to store.
  • Attempt to reverse-engineer, decompile, disrupt, overload, or gain unauthorized access to the App or its systems.
  • Resell, sublicense, or provide the App as a service to third parties without our permission.
  • Use the App to store others' personal data without a lawful basis to do so.

6. Your content

You retain all rights to the data and content you create or upload to BizTek ("Your Content"), including jobs, photos, reports, and documents. You grant us a limited license to host, process, transmit, and display Your Content solely as needed to operate and improve the Service for you. You are responsible for Your Content and for keeping your own backups where appropriate.

7. Customer data & your responsibilities

BizTek lets you store information about your own customers and jobs. You are the controller of that information and are solely responsible for collecting and using it lawfully, including providing any notices and obtaining any consents required by applicable data-protection law. We process this data on your behalf as described in our Privacy Policy.

8. AI-generated content

BizTek can generate draft service reports and similar content using artificial intelligence. AI output may be inaccurate, incomplete, or unsuitable for a given purpose. You are responsible for reviewing, editing, and verifying any AI-generated content before relying on or sending it. We make no warranty that AI output is accurate or fit for any particular purpose.

9. Third-party services

The App integrates with third-party services (for example, sign-in providers, maps, notifications, and AI providers). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services and do not control them.

10. Fees

Some features of BizTek may be offered free of charge, and others may require a paid plan or subscription. If paid features are introduced, the applicable pricing, billing, and renewal terms will be presented to you before you purchase, and any purchases made through the Apple App Store or Google Play are also subject to those stores' terms. Except where required by law or stated otherwise, fees are non-refundable.

11. Intellectual property

The App, including its software, design, branding, and the BizTek name and logo, is owned by Wartle.Soft and protected by intellectual-property laws. These Terms do not transfer any of our intellectual property to you.

12. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that data will never be lost. You use the App at your own risk.

13. Limitation of liability

To the maximum extent permitted by law, Wartle.Soft and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the App. To the maximum extent permitted by law, our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the twelve months before the claim or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Wartle.Soft from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the App, your violation of these Terms, or your violation of any law or the rights of a third party, including your customers.

15. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your license ends; sections that by their nature should survive (such as ownership, disclaimers, and limitation of liability) will survive.

16. Changes to these terms

We may update these Terms from time to time. When changes are material, we'll update the "Last updated" date and, where appropriate, notify you in the App. Continued use after changes take effect means you accept the updated Terms.

17. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which Wartle.Soft operates, without regard to conflict-of-laws principles. The courts of that jurisdiction will have exclusive jurisdiction over any dispute, except where applicable law gives you the right to bring proceedings in your local courts. Where required by law, nothing in these Terms limits your statutory consumer rights.

We will publish the specific governing jurisdiction here once Wartle.Soft's place of registration is finalized. Until then, mandatory consumer-protection laws of your country of residence continue to apply to you.
